By accessing cadencefx.com or subscribing to CadenceFX™ email alerts, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

CadenceFX™ is operated by TargetCast, Inc., an Ontario corporation. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

2. Description of Service

CadenceFX™ is a financial media service that monitors the USD/CAD exchange rate and delivers automated email alerts to subscribers when the rate moves meaningfully. The service uses official exchange rate data from the Bank of Canada.

CadenceFX™ is financial media, not financial advice. We report rate movements. We do not recommend transactions, provide personalized financial advice, predict future exchange rates, or facilitate currency conversions.

Nothing published or distributed by CadenceFX™ constitutes investment advice, financial advice, trading advice, or any other kind of advice. CadenceFX™ is not registered as an investment advisor, dealer, or financial institution under any applicable law.

All content is provided for informational purposes only. You should not make any financial decision based solely on information received from CadenceFX™. Consult a qualified financial advisor before making currency conversion or investment decisions.

4. No Liability

To the maximum extent permitted by applicable law, TargetCast, Inc. and CadenceFX™ shall not be liable for any loss or damage of any kind arising from:

CadenceFX™ sources published rate data from the Bank of Canada Valet API. While we use authoritative sources, we do not guarantee the accuracy, completeness, or timeliness of rate data. Exchange rates fluctuate continuously and the rate at time of alert may differ from the rate at time of conversion.

6. Subscription and Unsubscribe

Subscription to CadenceFX™ is free and requires only your email address. You may unsubscribe at any time using the unsubscribe link in any email. Unsubscribe requests are processed immediately.

We reserve the right to modify, suspend, or discontinue the service at any time without notice.

7. Intellectual Property

CadenceFX™, the tagline “delivered when it matters™”, and all content published by CadenceFX™ are the property of TargetCast, Inc. You may not reproduce, distribute, or create derivative works from CadenceFX™ content without prior written permission.

Bank of Canada is a trademark of the Bank of Canada. TargetCast, Inc. has no affiliation with, endorsement from, or commercial relationship with the Bank of Canada.

9. Dispute Resolution

9.1 Negotiation

In the event of any dispute arising from or relating to these Terms of Service or the CadenceFX™ service, the parties shall first attempt to resolve the dispute through good-faith negotiation. Either party may initiate negotiation by providing written notice to the other party describing the dispute in reasonable detail. The parties shall have thirty (30) days from the date of such notice to resolve the dispute through negotiation.

9.2 Mediation

If the dispute is not resolved through negotiation within thirty (30) days, either party may refer the dispute to mediation administered by ADR Chambers (Toronto, Ontario) in accordance with its mediation rules. The cost of mediation shall be shared equally by the parties.

9.3 Binding Arbitration

If the dispute is not resolved through mediation within sixty (60) days of the referral to mediation, the dispute shall be finally resolved by binding arbitration administered by ADR Chambers in accordance with its arbitration rules. The arbitration shall be conducted in Toronto, Ontario, in the English language. The arbitrator’s decision shall be final and binding on both parties. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

9.4 Class Action Waiver

All disputes shall be resolved on an individual basis. You waive any right to bring or participate in a class action, class arbitration, or representative proceeding against TargetCast, Inc. or CadenceFX™.

9.5 Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be posted on this page with an updated effective date. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
